Khaabarwala Ecommerce LLP:

These terms of use (the "Terms of Use") govern your use of our website www.Khaabarwala.com (the "Website") and our "Khaabarwala" application for mobile and handheld devices (the "App"). The App is jointly referred to as the "Platform." Please read these Terms of Use carefully before using the services. If you do not agree to these Terms of Use, you may not use the services on the Platform, and we request you to uninstall the App. By installing, downloading, or using the Platform, you contract with Khaabarwala and accept the Terms of Use and other Khaabarwala policies (including but not limited to the Cancellation & Refund Policy, Privacy Policy, and Take Down Policy) as posted on the Platform from time to time. These terms take effect on the date on which you download, install, or use the Services and create a legally binding arrangement to abide by them.

The Platform is operated and owned by Khaabarwala, having its registered office at Simantapally Rd, BESIDE LALPAHARI, Santiniketan, West Bengal 731235. For the purpose of these Terms of Use, wherever the context so requires, "you" shall mean any natural or legal person who has agreed to become a buyer or customer on the Platform by providing Registration Data while registering on the Platform as a registered user using any computer systems. The terms "Khaabarwala," "we," "us," or "our" shall mean Khaabarwala.

Khaabarwala enables transactions between participant restaurants/merchants and buyers, dealing in prepared food and beverages ("Platform Services"). Buyers ("Buyers") can choose and place orders ("Orders") from a variety of products listed and offered for sale by various neighborhood merchants, including but not limited to restaurants and eateries ("Merchants"), on the Platform. Khaabarwala enables delivery of such orders at select localities of serviceable cities across India ("Delivery Services"). The Platform Services and Delivery Services are collectively referred to as "Services." Khaabarwala may charge a delivery fee (inclusive of applicable taxes whenever not expressly mentioned).

AMENDMENTS

These Terms of Use are subject to modifications at any time. We reserve the right to modify or change these Terms of Use and other Khaabarwala policies at any time by posting changes on the Platform, and you shall be responsible for updating yourself on such changes by accessing the Platform. Your continued usage of the services after any change is posted constitutes your acceptance of the amended Terms of Use and other Khaabarwala policies. As long as you comply with these Terms of Use, Khaabarwala grants you a personal, non-exclusive, non-transferable, limited privilege to access, enter, and use the Platform.

By accepting these Terms of Use, you also accept and agree to be bound by the other terms and conditions and Khaabarwala policies (including but not limited to the Cancellation & Refund Policy, Privacy Policy, and Notice and Take Down Policy) as may be posted on the Platform from time to time.

USE OF PLATFORM AND SERVICES

All commercial/contractual terms are offered by and agreed to between Buyers and Merchants. This document is an electronic record in terms of the Information Technology Act, 2000, and amendments thereof. This electronic record is generated by a computer system and does not require any physical or digital signatures. Please read these terms and conditions carefully before registering, accessing, or using the service that we are providing via this app.

CONTACT INFORMATION

Mobile Number: After downloading the Khaabarwala app, a login page will require your mobile number. You must enter your mobile number to create your personal ID to use this app. You will receive an OTP via SMS on your registered number to verify authenticity. Every time you log out, you must verify again to log in. It is your responsibility to provide a correct mobile number so that we can communicate with you via SMS. If you want to change your registered number, the verification process remains the same.
Email Address: After registering your mobile number, you must provide your name and email ID. There will be no verification process for your email ID. This email will appear at the top of your profile, and you can change it anytime via the 'Profile Setting' option. When you place an order, you can specify an email ID for receiving documents. It is your responsibility to provide a correct email ID to facilitate communication.

PLATFORM FOR PAYMENT

While using any payment methods available on the App, Khaabarwala is not responsible for any loss or damage due to:

Lack of authorization for transactions.
Exceeding limits mutually agreed upon between you and banks.
Payment issues arising from transactions.
Declined transactions for any other reasons.

All payments on the app must be in Indian Rupees. The app does not support any other currency. Before delivery, sellers may request supporting documents (e.g., government-issued ID and address proof) to establish ownership of the payment method used. Payments must be made only through the app using Debit Cards, Credit Cards, Net Banking, UPI, and Paytm Wallet. There is no third-party involvement. The total amount shown in the order details is the only amount you pay�there are no hidden charges.

SAFETY

Khaabarwala ensures the security and privacy of your content, including text, images, or other materials provided on the platform. We delete all content after delivery. In the case of typing orders, documents are deleted after 10 days to allow for editing purposes.

PRIVACY

We view protection of your privacy as a very important principle. We understand clearly that your personal information is one of our most important assets. We store and process your information, including any sensitive financial information collected (as defined under the Information Technology Act, 2000), on computers protected by security measures in accordance with applicable laws. If you object to the transfer or use of your information in this manner, please do not use Khaabarwala.

We will never disclose personal information to third parties. Our employees continually work on security processes to protect user data.

LIMITATION OF LIABILITY

In no event shall Khaabarwala, its licensors, suppliers, or vendors, including their officers, directors, employees, or agents, be liable for any special, incidental, indirect, or consequential damages, or for any damages resulting from loss of use, data, or profits. This includes but is not limited to damages arising from:

Mistakes, omissions, viruses, or interruptions in service.
Failure to provide products or services ordered from Khaabarwala.
Any inappropriate or unauthorized use of the platform or its content.

When you use our App, we collect and store information provided by you. Our primary goal is to provide a safe, efficient, smooth, and customized experience. We collect personal information necessary for these purposes. By using this app, you agree to be bound by these Terms and Conditions of Khaabarwala.
