These terms of use (the "Â Terms of Use") govern your use of our website www.Khaabarwala.com (the "Â Website") and our "Khaabarwala" application for mobile and handheld devices (the "Â App"). The App is jointly referred to as the "Â Platform". Please read these Terms of Use carefully before you use the services. If you do not agree to these Terms of Use, you may not use the services on the Platform, and we request you to uninstall the App. By installing, downloading or even merely using the Platform, you shall be contracting with Khaabarwala and you signify your acceptance to the Terms of Use and other Khaabarwala policies (including but not limited to the Cancellation & Refund Policy, Privacy Policy and Take Down Policy) as posted on the Platform from time to time, which takes effect on the date on which you download, install or use the Services, and create a legally binding arrangement to abide by the same. The Platform is operated and owned by Khaabarwala having its registered office at Simantapally Rd, BESIDE LALPAHARI, Santiniketan, West Bengal 731235. For the purpose of these Terms of Use, wherever the context so requires, "you" shall mean any natural or legal person who has agreed to become a buyer or customer on the Platform by providing Registration Data while registering on the Platform as a registered user using any computer systems. The terms "Khaabarwala", "we", "us" or "our" shall mean Khaabarwala. Khaabarwala enables transactions between participant restaurants/merchants and buyers, dealing in prepared food and beverages ("Â Platform Services"). The buyers ("Â Buyer/s") can choose and place orders ("Â Orders") from variety of products listed and offered for sale by various neighbourhood merchants including but not limited to the restaurants and eateries ("Â Merchant/s"), on the Platform and Khaabarwala enables delivery of such orders at select localities of serviceable cities across India ("Â Delivery Services"). The Platform Services and Delivery Services are collectively referred to as "Â Services". For the delivery services rendered, Khaabarwala may charge you delivery fee (inclusive of applicable taxes whenever not expressly mentioned) AMENDMENTS These Terms of Use are subject to modifications at any time. We reserve the right to modify or change these Terms of Use and other Khaabarwala policies at any time by posting changes on the Platform, and you shall be liable to update yourself of such changes, if any, by accessing the changes on the Platform. You shall, at all times, be responsible for regularly reviewing the Terms of Use and the other Khaabarwala policies and note the changes made on the Platform. Your continued usage of the services after any change is posted constitutes your acceptance of the amended Terms of Use and other Khaabarwala policies. As long as you comply with these Terms of Use, Khaabarwala grants you a personal, non-exclusive, non-transferable, limited privilege to access, enter, and use the Platform. By accepting these Terms of Use, you also accept and agree to be bound by the other terms and conditions and Khaabarwala policies (including but not limited to Cancellation & Refund Policy, Privacy Policy and Notice and Take Down Policy) as may be posted on the Platform from time to time. Use of Platform and Services All commercial/contractual terms are offered by and agreed to between Buyers and This document is an electronic record in terms of Information Technology Act, 2000, amendments thereof from time to time and rules there under as applicable and the amended provisions pertaining to electronic records in various statutes as amended by the Information Technology act,2000. This electronic record is generated by computer system and does not require any physical or digital signatures. Please read the terms and conditions carefully before registering, accessing or using the service that we are providing via this app. The terms and conditions is a legal contract between you and Khaabarwala. You agree to acknowledge that you have read the terms and conditions set forth below. If you don't agree to these terms and conditions, you may not use the services or immediately terminate the services. We may change the terms and conditions at any time by posting an update version. The updated version of the Terms of service shall take effect immediately upon posting. It is your responsibility to review these Terms of use periodically for updates/change. As long as you comply with this terms of use, we grant you a personal, non-exclusive, no-transferable privilege to enter and avail the services.

1. Mobile Number: After downloading the Khaabarwala app, there will be a login page which will require your mobile number. You have to enter your mobile number to create your personal id to use this app. After entering the mobile number you will receive an OTP via SMS on your registered number, it's only to make sure that the number you have given us is genuine. Every time you log out from this app, to login again you have to enter your registered mobile number and verify it again. If you enter another number you will be directed to a new profile, but for your previous profile you have to enter the previous mobile number. It is your responsibility to provide your correct mobile number so that we can communicate with you via SMS. If there is any problem with your registered mobile number or you want to change your given number you can go for it, but the verifying process will be the same.
2. Email Address: After registering your mobile number first time on this app you will be asked for your name and email id. There will be no verification process for your email id. This email will be shown on right at the top of your profile. You can change your name and email id whenever you want by going through the 'Profile Setting' option. When you place an order (only for typing) on this app you can give us the email id by which you want to receive your documents, this email id can vary as you want to. It's your responsibility to provide your correct email id so that we can contact with you via email and send you our latest offers, details about our app.
Platform for Payment:
While availing any of the payment methods available on the App, we will not be responsible or assume any liability, whatsoever in respect of any loss or damage arising directly or indirectly to you due to: 1. Lack of authorization for any transactions, or 2. Exceeding the present limit mutually agreed by You and between 'Banks', or 3. Any payment issues arising out of the transaction, or 4. Decline of transaction for any other reasons
All payments made against the services on app by you shall be compulsorily in Indian Rupees acceptable in the Republic of India. App will not facilitate any other form of currency with respect to the purchases made on this app.
Before delivering your order to you, Seller may request you to provide supporting documents (including Govt. issued id and address proof) to establish the ownership of the payment method used by you for your service. This is done in the interest of providing a safe online service to our customers. In this app you have to pay us after your order is being approved. To pay us you can use Debit Card, Credit Card, Net Banking, UPI and Paytm Wallet. In this app you only pay us, there is no third-party involved. Please make sure that you don't pay anywhere out of this app. The total value shown in the order details is the only amount you pay us, there is no hidden charges or transection charges you have to pay. So, the procedure of paying us is so easy.
Saftey:
The 'Khaabarwala' will keep all of your content, shall mean text, image or other material you choose to give on this application, secure, private and safe. Khaabarwala will delete all of your content after you received your delivery. In case of typing order your documents will be deleted after 10 days of the delivery. It will be kept in our repository for your editing purposes.
Privacy:
We view protection of your privacy as a very important principle. We understand clearly that you and your personal information is one of our most important assets. We store and process your information including any sensitive financial information collected (as defined under the Information Technology Act, 2000), if any, on computers that may be protected by physical as well as reasonable technological security measures and procedures in accordance with Information Technology Act 2000 and Rules there under. If you object to your information being transferred or used in this way please do not use Khaabarwala.
We will never disclose personal information to third parties. Be comfortable to use our services it's totally harmless and secured. Our employs are always working on the security process of the App.
Limitation of Liability
In no event shall Khaabarwala or its licensors, suppliers, or vendors, their officers, directors, employees, or agents be liable for any special, incidental, indirect, or consequential damages of any kind, or for any damages whatsoever resulting from loss of use, data, or profits, whether or not Khaabarwala has been advised of the possibility of damage, arising out of or in connection with the use or performance of the site or of failure to provide products or services that you order from Khaabarwala or its affiliates, including without limitation, damages arising from mistake, omission, virus, delay, or interruption of service. In no event shall Khaabarwala be liable or responsible for any damages or consequences arising from or related to your inappropriate or unauthorized use of this site or its content.
